Silvia Terms of Service

1. Acceptance of the Terms

By accessing or using Silvia (getsilvia.com), you accept these Terms of Service. If you do not agree, do not use the platform. Continued use of Silvia constitutes acceptance of any modification to these terms.

2. Description of the Service

Silvia is a digital management platform designed for content creators and influencers. The service includes: management of brand deals, payment and collection tracking, an AI-assisted sales pipeline, media kit generation, a publishing calendar, automated tasks, an AI chatbot and revenue analytics.

Silvia is a management and assistance tool. Recommendations generated by the artificial intelligence are indicative and do not constitute financial, legal or professional advice. The user is responsible for the decisions they make based on those recommendations.

3. Registration and Account

To use Silvia you need to create an account providing truthful and up-to-date information. You are responsible for keeping your access credentials confidential and for all activity that occurs under your account. You must notify us immediately if you suspect unauthorized use of your account.

Requirements to register:

  • Be at least 18 years of age
  • Provide a valid email address
  • Not have been previously suspended or removed from the platform

4. Trial Period and Subscription

Silvia offers a free trial period of 14 days with no credit card required. During the trial period you have full access to every feature.

When the trial period ends, you may subscribe to the paid plan to continue using the service. Prices are published on the plans page and may be modified with 30 days' prior notice.

The subscription renews automatically every month. You may cancel at any time from your profile. On cancelling, you keep access until the end of the period already paid for.

5. Payments and Billing

Payments are processed through Stripe, a third-party payment processor. Silvia does not store credit card data on its servers. By providing payment information, you accept Stripe's terms of service.

Charges are made in United States dollars (USD). The user is responsible for any tax applicable in their jurisdiction.

No refunds are made for partial periods of use. If you cancel your subscription, access is kept until the end of the current billing cycle.

6. Acceptable Use

By using Silvia, you agree not to:

  • Use the platform for illegal or fraudulent activities
  • Attempt to access other users' accounts
  • Reverse engineer, decompile or attempt to extract the source code
  • Use bots, scrapers or automated tools to access the service
  • Upload malicious content, viruses or harmful code
  • Use the platform to send spam or unsolicited communications
  • Infringe third-party intellectual property rights
  • Intentionally overload the servers or the infrastructure of the service
  • Resell, redistribute or sublicense access to Silvia

7. Intellectual Property

All content, design, code, trademarks and technology of Silvia are the exclusive property of its creators and are protected by the applicable intellectual property laws.

The user retains all rights over the data and content they upload to the platform. By using Silvia, you grant us a limited licence to process, store and display your content solely for the purpose of providing you the service.

8. User Data

The data you upload to Silvia (brand deals, revenue, tasks, etc.) is yours. You may export or delete your data at any time. When you delete your account, all your data will be removed from our servers within a maximum of 30 days.

We do not sell, share or assign users' personal or commercial data to third parties, except where necessary to provide the service (for example, payment processing through Stripe).

9. Artificial Intelligence

Silvia uses third-party artificial intelligence services (including but not limited to Google Gemini) to provide features such as the chatbot, the sales pipeline and metric extraction.

Data sent to these AI services is used exclusively to generate responses and is not stored by the AI providers to train their models, according to their respective privacy policies.

Responses generated by the AI are indicative and may contain errors. Silvia does not guarantee the accuracy, completeness or suitability of the advice generated by the artificial intelligence.

10. Service Availability

We strive to keep Silvia available 24 hours a day, 7 days a week. However, we do not guarantee uninterrupted availability. The service may be temporarily unavailable due to maintenance, updates or circumstances beyond our control.

11. Limitation of Liability

Silvia is provided "as is" and "as available". To the maximum extent permitted by law:

  • We do not guarantee that the service is free of errors or interruptions
  • We are not responsible for commercial decisions made on the basis of the AI's recommendations
  • We are not responsible for data loss caused by circumstances beyond our control
  • Our maximum liability is limited to the amount paid by the user in the last 12 months
  • We are not responsible for indirect, incidental, special or consequential damages

12. Indemnification

The user agrees to indemnify and hold harmless Silvia, its creators, directors and employees against any claim, damage, loss or expense (including legal fees) arising from use of the platform, breach of these terms or infringement of third-party rights.

13. Termination

We may suspend or terminate your access to Silvia if:

  • You breach these Terms of Service
  • You use the platform fraudulently or abusively
  • You do not pay your subscription after the grace period
  • It is required by law or a competent authority

You may cancel your account at any time from your profile or by contacting soporte@getsilvia.com.

14. Modifications

We reserve the right to modify these terms at any time. Changes will be notified by email or through a notice on the platform at least 15 days in advance. Continued use after the effective date of the changes constitutes acceptance of them.

15. Governing Law and Jurisdiction

These terms are governed by the laws of Mexico. Any dispute will be submitted to the jurisdiction of the competent courts of Mexico City, waiving any other venue that might apply.
